The Senate Judiciary Committee heard HB 1504 on enforcement of deceptive consumer sales act sponsored by Sen. Messmer and authored by Rep. Speedy. This bill amends the definition of “consumer transaction” and allows the attorney general to intervene and file suit when the commercial transaction was between two companies but harmed consumers as a result. The bill also extends the statute of limitations to five (5) years for the attorney general to bring an action to enjoin a deceptive act.
The bill was amended to strip the entire bill except for the portion that extends the statute of limitations for the attorney general to file suit. The Indiana Attorney General’s Office testified in support of the bill. The amended bill passed 11-0.
