The Senate Family and Children Services Committee heard SB 109 on adult protective services authored by Sen. Crider. The bill amends who the division of aging can contract with to provide adult protective services. Currently, the statute allows a contract with:
- a prosecuting attorney,
- a prosecuting attorney and a governmental agency where each will perform part of the required services, or
- a governmental entity if the prosecuting attorney decides not to enter a contract.
The bill permits DCS to contract with:
- A prosecuting attorney,
- a prosecuting attorney and a governmental agency where each will perform part of the required services, or
- a person qualified to provide adult protective services
DCS would no longer be able to contract with a governmental entity if a prosecuting attorney decides not to enter into a contract.
FSSA and the Indiana Association of Area Agencies on Aging testified in support of the proposed legislation.
The bill passed 6-0.
