Statute of limitations

At a previous meeting, the Senate Corrections and Criminal Law Committee heard SB 151 on statute of limitations authored by Sen. Alexander and Sen. Crider.  The bill allows the prosecution of certain sex offenses to be commenced at any time and makes conforming changes. The Indiana Coalition to End Sexual Assault and Human Trafficking, the Indiana Prosecuting Attorneys Council, two sexual assault survivors, and a parent testified in support of the bill. The Indiana Public Defender Council testified in opposition to the bill.

On January 30, 2024, the bill was heard for amend and vote.  The committee amended the bill by consent to eliminate the statute of limitations for Level 3 felony rape and child molesting, specify that DNA revival provisions may still apply to offenses barred due to the expiration of a previous statute of limitations, and make conforming amendments. The amended bill passed 7-0.
