The House Courts and Criminal Code Committee heard HB 1137 authored by Rep. Smaltz, Rep. Lucas, and Rep. Teshka on expungement of red flag law records. The bill requires a court to expunge certain records related to the red flag law if the court finds that an individual is not dangerous or is no longer dangerous.
The bill was amended by consent to provide a judicial officer discretion in expunging red flag records if an individual is initially found to be dangerous but is later found to no longer be dangerous. The National Rifle Association, the Indiana State Rifle and Pistol Association, an attorney, and a private citizen testified in support of the bill.
The amended bill passed 11-0.
