The Senate Corrections and Criminal Law Committee heard HB 1137 on expungement of red flag law records sponsored by Sen. Freeman and Sen. Koch. Author Rep. Smaltz introduced the bill which requires a court to expunge certain records related to the red flag law if the court finds that an individual is not dangerous, and permits a court to expunge certain records related to the red flag law if the court finds that an individual previously found to be dangerous is no longer dangerous. The bill outlines the procedures for hearings, the burden of proof, and the expungement process. It also specifies that law enforcement must return firearms to individuals found not dangerous within five days.
The Indiana Public Defender Council, 2A Project, Indiana State Rifle and Pistol Association, and various citizens testified in support of the bill. The bill passed 9-0.
