The House Courts and Criminal Code Committee heard SB 219 on trespass sponsored by Rep. McNamara. Author Sen. Clark introduced the bill which provides that a person who, not having a contractual interest in the property, knowingly or intentionally enters the real property of another person after having been denied entry by the other person, that person’s agent, or a law enforcement officer acting on behalf of the other person or their agent, commits criminal trespass, a Class A misdemeanor. The bill also provides that a person who, not having a contractual interest in the property, knowingly or intentionally refuses to leave the real property of another person after having been asked to leave by the other person, that person’s agent, or a law enforcement officer acting on behalf of the other person or the other person’s agent, commits criminal trespass, a Class A misdemeanor.
The Indiana Sheriffs’ Association testified in support of the bill. The bill passed 13-0.
