The Senator Corrections and Criminal Law Committee heard HB 1393 regarding immigration notice sponsored by Sen. Freeman and Sen. Maxwell. Author Rep. Bascom testified that the bill mandates law enforcement to arrest any individual believed to be unlawfully in the United States if there is probable cause to believe that the individual committed a crime. The sheriff of the arresting county is required to notify the proper authority of the arrest. The bill also provides immunity from civil liability if the statutory requirements have been fulfilled.
The Committee amended the bill by consent to make the arrest discretionary and require the jail or the detention facility holding the individual to notify the proper authority. The Indiana Sheriffs’ Association and the Indiana Public Defender Council provided neutral testimony. A significant amount of testimony was heard in opposition to the bill, including from the
American Civil Liberties Union of Indiana and representatives of the Catholic church. The amended bill passed 5-3.
