The Senate Corrections and Criminal Law Committee heard HB 1687 regarding probation transfers for sex and violent offenders sponsored by Sen. Johnson and Sen. Alexander. Author Rep. Smaltz testified that the bill controls the migration of sex and violent offenders by requiring both the sending and receiving courts to agree to the probation transfer. The bill also places limitations on the employment of sex and violent offenders if there will be regular contact with children.
The Committee amended the bill by consent to require the order authorizing the transfer to include findings of fact consistent with the conditions contained in the bill. Testimony in support of the bill was heard from an advocacy organization for sexual violence survivors and the Indiana Public Defender Council. One citizen testified in opposition. The amended bill passed 9-0.
