On March 11, 2025, the Senate Corrections and Criminal Law Committee heard HB 1006 on prosecutors. The bill is sponsored by Sen. Freeman and Sen. Carrasco and authored by Rep. Jeter. Sen. Freeman presented the bill, which provides a special prosecutor unit, a prosecutor review board, and a public prosecution fund. It sets guidelines and standards that allow counties to be eligible for reimbursement of prosecution-related expenses. The Indiana Prosecuting Attorneys Council and the Indiana Commission on Court Appointed Attorneys testified in support of the bill.
On March 25, 2025, on hearing for amend and vote only, the Committee adopted three amendments to require that members appointed to the Indiana Commission on Court Appointed Attorneys must be trial court judges from counties that receive reimbursement from the Commission, specifies the reimbursement for a deputy prosecuting attorney’s salary may not exceed 27.5% of the elected prosecuting attorney’s salary from the public prosecution fund, specifies the appointments and terms for the prosecutor review board, and set the number of review board members that can be from the same political party.
The amended bill passed 5-3 and the bill was recommitted to Senate Appropriations.
