The Senate Appropriations Committee heard SB 275 on FSSA fiscal matters authored by Sen. Mishler and Sen. Garten. The bill in relevant part repeals language providing that a claim by the estate recovery unit of the Medicaid policy and planning (estate recovery unit) is forever barred unless the estate recovery unit files a claim in court in which the decedent’s estate is being administered or the estate recovery unit opens an estate for the decedent and files a claim against the decedent’s estate not later than 120 days after the date of death of the decedent.
The Committee amended the bill by consent to provide that a claim by the estate recovery unit is forever barred unless the unit files a claim in court in which the decedent’s estate is being administered not later than 180 days after the estate has been opened. The Indiana Family and Social Services Administration, Indiana Land Title Association, and Indiana State Bar Association Probate, Trust and Real Property section provided neutral testimony. The amended bill passed 9-3.
