The House Judiciary Committee heard HB 1286 on military protective order authored by Rep. Lauer. The bill requires a party to a protective order proceeding to inform the court of any military protective orders issued by a military commander in effect between the parties. The bill also requires the court to consider evidence of a military protective order in effect against a respondent for the protection of the petitioner and allows the court to grant an ex parte order for protection based upon this evidence.
The Committee amended the bill by consent to do the following:
- Provide the court discretion in considering evidence of a military protection order in effect against a respondent;
- Add that certain protection orders issued by a Canadian court are facially valid foreign protection orders; and
- Make grammatical changes.
The Military/Veterans Coalition of Indiana and a veteran testified in support of the bill. The amended bill passed 13-0.
