Legislative Update

Military protective order

February 13, 2026 Filed Under: Civil

The Senate Judiciary Committee heard HB 1286 on military protective order sponsored by Sen. Carrasco and authored by Rep. Lauer. The bill specifies that a party to a protective order proceeding has a duty to inform the court of any military protective orders issued by a military commander in effect between the parties. The bill also allows the court to consider evidence of a military protective order in effect against a respondent for the protection of the petitioner and allows the court to grant an ex parte order for protection based upon this evidence. In addition, the bill amends provisions concerning facially valid foreign protection orders to include certain protection orders issued by a Canadian court.

The bill passed 10-0.
