The House Ways and Means Committee heard SB 275 on FSSA fiscal matters sponsored by Rep. Lopez and Rep. Jordan. The bill in relevant part provides that a claim by the estate recovery unit of the office of Medicaid policy and planning (estate recovery unit) is forever barred unless the estate recovery unit files a claim in the court in which the decedent’s estate is being administered not later than 365 days after the date of the death of the decedent.
The Committee amended the bill by consent on issues unrelated to estates. An amendment was introduced to change the timeframe for the Medicaid estate recovery unit to file against an estate from one year to six months. The amendment failed 9-15.
The amended bill passed 24-0.
