Legislative Update

Controlled substances and public servant impersonation

January 15, 2016 Filed Under: Criminal

The House Corrections and Criminal Law Committee heard SB 174 concerning controlled substances and public servant impersonation authored by Sen. R. Michael Young. In follow-up to last week’s discussion, Sen. Young introduced an amendment to this bill that, as proposed:

  1. establishes a Class A misdemeanor for impersonating a public servant with intent to defraud or induce compliance with instructions, orders, or requests;
  2. creates the crime of dealing in a controlled substance by a health care provider; and permits sentence enhancement for dealing in Schedule I, II, or III controlled substances and dealing a controlled substance by a health care provider if the offense proximately caused another person’s death; and
  3. precludes certain defenses.

A representative from the Indiana Attorney General’s Office testified in support of the bill as amended. The amendment was adopted by consent, and the amended bill passed 7-1.
