Unlawful encroachment by a sex offender

The Senate Corrections and Criminal Law Committee heard SB 12 on unlawful encroachment by a sex offender, authored by Sen. Bohacek.  The bill provides that a sex offender who establishes a residence: (1) with the intent to reside at the residence; and (2) within a one-mile radius of the residence of the victim of the offender’s sex offense; commits unlawful encroachment by a sex offender, a Level 6 felony. The bill also makes conforming changes.
The bill was amended by consent to provide for a waiver of the residency requirement, provide certain exceptions to prosecution, and add a mens rea requirement.  The bill passed as amended 9-0.
