The House Courts and Criminal Code Committee heard Rep. Lauer’s HB 1192 on theft by public servants. The original bill required that a public servant who commits theft of public funds having a value of at least $750 be sentenced to a mandatory term of imprisonment of at least 30 days as part of the sentence; and it specified that: (1) the mandatory term is not suspendible; and (2) the person does not earn good time credit while serving the mandatory term.
The bill was amended by consent to remove the mandatory minimum sentence provision and instead include a provision allowing the court to garnish the person’s pension to recoup the stolen public funds. A representative of the Indiana Prosecuting Attorneys Council testified in support of the bill. A representative of the Indiana Public Defender Council testified against it. The amended bill passed 12-0.
