Nonconsensual pornography

The Senate Committee on Corrections and Criminal Law heard Sen. Freeman’s SB 243 concerning nonconsensual pornography.  This bill makes it a Class A misdemeanor for a person to distribute or display an intimate image of an individual whom the person knows or reasonably should know does not consent to the distribution or display of the intimate image.  The penalty is increased to a Level 6 felony with a prior conviction.
The bill was amended by consent to limit the offense to images shared on the internet, the only remaining portion not covered by other offenses in the code. Testifying in support of the bill was the Indiana Prosecuting Attorneys Council; a victim; and Women 4 Change. Testifying in opposition were the Motion Picture Association; and the Indiana Public Defender Council. The bill passed 7-0.
