The House Courts and Criminal Code Committee heard SB 243, sponsored by Rep. Speedy, on nonconsensual pornography. This bill defines “intimate image” and provides that a person who knows that an individual does not consent to the posting of an intimate image of the individual on the Internet and posts the image on the Internet; commits internet distribution of an intimate image, a Class A misdemeanor. It also increases the penalty to a Level 6 felony for a second or subsequent offense.
The bill was amended to include HB 1333, the House’s version of the bill on nonconsensual pornography. A victim, Women for Change Indiana, and the Indiana Prosecuting Attorneys Council testified in support of the bill. The Indiana Public Defenders Council testified against the bill. The amended bill passed 11-0.
