The House Courts and Criminal Code Committee heard HB 1159 concerning juvenile expungements and firearm matters authored by Rep. Schaibley. The bill would require juvenile courts to transmit information to Office of Judicial Administration for transmission to NICS upon finding of a delinquent act that would be a serious violent felony if committed by an adult, allows the court to consider specific factors in evaluating petitions for expungement of certain juvenile adjudications, requires courts to transmit certain orders to Office of Judicial Administration regarding juvenile expungements, provides if a person was adjudicated a delinquent for an act while armed with a firearm that would be a serious violent felony if committed by an adult that is not expunged and the person knowingly or intentionally possesses a firearm the person commits a class A misdemeanor of unlawful possession of a firearm by a dangerous person, which can be enhances up to a Level 4 if the person has prior unrelated conviction for this offense, and provides that a person adjudicated a delinquent for an act while armed with a firearm that would be a serious violent felony if committed by an adult is not a proper person for receiving a handgun license.
The bill was amended by consent to incorporate provisions similar to HB 1383 requiring Office of Judicial Administration to collect and publish statistics related to the confiscation and retention of firearms, and adds a person commits a class B misdemeanor, false reporting, if the person makes a false report that a person is dangerous knowing the report or information is false. Testimony was received from the Noblesville School Superintendent, parent of Noblesville school student, and Indiana Public Defender Council. The amended bill passed 11-0.
