The Senate Judiciary Committee heard HB 1124 on civil proceedings advance payment contracts (CPAP)(for profit litigation funding) sponsored by Sen. Liz Brown and Sen. Mark Messmer. Rep Matt Lehman introduced the bill explaining it requires anyone entering a CPAP contract to provide notice of the existence the contract to other parties in a civil litigation. CPAP must also be shared with any insurer that has a duty to defend another party in the civil action.
An amendment making existence and content of CPAP discoverable and limiting the CPAP report admissibility passed 7-3.
Eric Schuler for the Alliance of Responsible Consumer Legal Funding (CPAP industry) testified in opposition and requests that the content not be permitted to be used against the litigant. The Insurance Industry of Indiana testified in support of the legislation. The amended bill passed8-2.
