Unlawful encroachment

The House Courts and Criminal Code Committee heard HB 1122 on unlawful encroachment authored by Rep. McNamara.  The bill authorizes a law enforcement officer to order a person to stop approaching the law enforcement officer if the officer reasonably believes that the person’s presence within 25 feet of the officer will interfere with the performance of the officer’s duties. The bill also provides that a person who knowingly or intentionally approaches within 25 feet of a law enforcement officer after being ordered to stop approaching commits unlawful encroachment on a law enforcement officer, a Class C misdemeanor. 

The Evansville Police Department, Indiana Fraternal Order of Police, and the Indiana Association of Chiefs of Police testified in support of the bill.  The American Civil Liberties Union of Indiana testified but remained neutral.  The bill passed 10-3.
