Legislative Update

Public safety

February 13, 2026 Filed Under: Criminal

The House Courts and Criminal Code Committee heard SB 160 on public safety sponsored by Rep. Lopez and authored by Sen. Deery and Sen. Clark.  The bill makes wearing a mask during the commission of a criminal offense a sentencing aggravator. The bill also makes it malicious littering, a Class A misdemeanor, for a person to place refuse on the property of another person with the intent to cause the owner or occupant of the property to reasonably fear for their physical safety.

The Committee amended the bill by consent to specify that the definition of refuse applies to malicious littering.

The Indiana Association of Chiefs of Police, Jewish Community Relations Council, and the Anti-Defamation League testified in support the bill. The amended bill passed 11-1.
